konflik antara penjual dan konsumen

ada seorang konsumen yang membeli sebuah produk berupa alat ksehatan. awalnya memang pegawainya yang menawarkan dan berusaha membujuk sang konsumen agar membeli produknya tersebut, dan pada akhirnya konsumen tertarik pada produk yang ditawarkan tersebut dan kemudian membeli. ketika barang tersebut sudah dibeli dan dipakai oleh konsumen tersebut, ternyata produknya tersebut kurang memuaskan (dalam arti disini produk tersebut rusak/cacat). Konsumen tersebut pun akhirnuya kembali ketempat barang itu dijual dan kemudian komplain kepada penjualnya, pertamanya penjual itu tidak percaya dan memberi alasan yang berbelit-belit,dengan melalui proses perdebatan yang sangat panjang dan setelah dicoba lagi ternyata ,memang benar produk tersebut rusak/cacat. penjual itupun kemudian meminta maaf dan memberi solusi dengan menggangti dengan produk lain yang sejenis. konsumen itu juga setuju dengan solusi yang ditawarkan penjual tersebut, dan akhirnya terjadi kesepakatan antara penjual dan pembeli (konsumen) tersebut, masalahnya pun dapat terselesaikan dengan baik.

Analisis :
Dari sudut etika bisnis menurut saya cara tersebut dibilang baik, karena dapat menyelesaikan masalah dengan baik dan cepat antara produsen dan konsumen. akan tetap seharusnya penjual jika mendapatkan komplain mencoba barang yang rusak/cacat membuktiannya tidak harus berdebat terlebih dahulu, karena seharusnya penjual itu mengutamakan respon cepat tanggap dalam masalah ini.

Dewan Perwakilan Rakyat (DPR) mendesak pemerintah untuk menindak tegas secara hukum perusahaan-perusahaan penambangan yang tidak mematuhi proses Analisis Mengenai Dampak Lingkungan (AMDAL), program reklamasi pasca tambang dan menjaga keseimbangan ekosistem saat melakukan eksplorasi maupun produksi.

“Pemerintah pusat dan pemerintah daerah harus berkomitmen kuat menekan degradasi lingkungan dengan secara tegas menindak perusahaan-perusahaan yang melakukan kerusakan,” tegas Anggota Komisi VII DPR Rofi Munawar dalam keterangan tertulisnya di Jakarta, Jumat (1/3/2013).

Di samping itu, pemerintah juga diminta melakukan langkah-langkah perbaikan kualitas lingkungan hidup secara nasional, diantaranya lebih meningkatkan Indeks Kualitas Lingkungan Hidup (IKLH) diseluruh wilayah Indonesia, yang berpredikat sedang dan rendah termasuk daerah rawan bencana.

“Kementerian LH juga harus mempublikasikan dokumen izin lingkungan dan izin pengelolaan limbah B3 setiap kegiatan yang sudah dikeluarkan oleh Pemerintah sebagai bentuk transparansi dan tanggung jawab sosial kepada masyarakat.” tegas Rofi.

Sebagai catatan, Kementerian LH sejak tahun 2010 memberikan 77 izin penggunanan lahan hutan untuk pertambangan. Sejak itu pula 43.136 hektar lahan telah dimanfaatkan untuk pertambangan. Selain itu ada juga 68 izin pinjam pakai hutan seluas 50.113 hektar.

Namun, saat ini tingkat ketaatan kinerja pengendalian pencemaran lingkungan yang dilakukan industri hanya mencapai 69 persen. Badan Pemeriksa Keuangan (BPK) belum lama ini melaporkan terdapat 26 perusahaan pertambangan yang tidak mengikuti aturan yang berlaku, sehingga menimbulkan potensi kerugian negara sebanyak Rp90,6 miliar dan USD38 ribu.

Analisis : Menurut saya pengelolaan limbah perusahaan tambang harus dijaga lebih ketat dari pemerintah, karena jika terus menerus pemerintah kecolongan maka dampak buruk dari limbah akan merusak atau mencemari lingkungan di wilayah sekitarnya dan dampaknya sangat merugikan bagi Negara karna tidak hanya wilayah yang rusak tetapi menimbulkan kerugian materi bagi negara.

Pengertian Korupsi, Etika Bisnis dan Hubungan Etika bisnis dengan korupsi.
Korupsi (bahasa Latin: corruptio dari kata kerja corrumpere yang bermakna busuk, rusak, menggoyahkan, memutarbalik, menyogok). Secara harfiah, korupsi adalah perilaku pejabat publik, baik politikus politisi maupun pegawai negeri, yang secara tidak wajar dan tidak legal memperkaya diri atau memperkaya mereka yang dekat dengannya, dengan menyalahgunakan kekuasaan publik yang dipercayakan kepada mereka.

Dari sudut pandang hukum, tindak pidana korupsi secara garis besar mencakup unsur-unsur sebagai berikut:

Selain itu terdapat beberapa jenis tindak pidana korupsi yang lain, di antaranya:
• memberi atau menerima hadiah atau janji (penyuapan);
• penggelapan dalam jabatan;
• pemerasan dalam jabatan;
• ikut serta dalam pengadaan (bagi pegawai negeri/penyelenggara negara);
• menerima gratifikasi (bagi pegawai negeri/penyelenggara negara).

Dalam arti yang luas, korupsi atau korupsi politis adalah penyalahgunaan jabatan resmi untuk keuntungan pribadi. Semua bentuk pemerintah pemerintahan rentan korupsi dalam prakteknya. Beratnya korupsi berbeda-beda, dari yang paling ringan dalam bentuk penggunaan pengaruh dan dukungan untuk memberi dan menerima pertolongan, sampai dengan korupsi berat yang diresmikan, dan sebagainya. Titik ujung korupsi adalah kleptokrasi, yang arti harafiahnya pemerintahan oleh para pencuri, dimana pura-pura bertindak jujur pun tidak ada sama sekali.

Korupsi yang muncul di bidang politik dan birokrasi bisa berbentuk sepele atau berat, terorganisasi atau tidak. Walau korupsi sering memudahkan kegiatan kriminal seperti penjualan narkotika, pencucian uang, dan prostitusi, korupsi itu sendiri tidak terbatas dalam hal-hal ini saja. Untuk mempelajari masalah ini dan membuat solusinya, sangat penting untuk membedakan antara korupsi dan kriminalita kejahatan.
Tergantung dari negaranya atau wilayah hukumnya, ada perbedaan antara yang dianggap korupsi atau tidak. Sebagai contoh, pendanaan partai politik ada yang legal di satu tempat namun ada juga yang tidak legal di tempat lain.

Etika bisnis adalah cara-cara untuk melakukan kegiatan bisnis, yang mencakup seluruh aspek yang berkaitan dengan individu, perusahaan, industri dan juga masyarakat.

Hubungan etika bisnis dengan korupsi yaitu dimana dalam Korupsi menurut buku kecil yang ditertibkan KPK Mengenali & Memberantas Korupsi sebenarnya tidak beda jauh dengan pencurian dan penggelapan. Hanya saja unsur-unsur pembentuknya lebih lengkap. Kalau diumpamakan suatu wilayah, korupsi adalah wilayah hitam, yaitu wilayah yang secara etika jelas-jelas tidak diterima. Berhadapan dengan wilayah hitam adalah wilayah putih, yaitu wilayah yang secara etika dapat diterima. Nah, di antara wilayah hitam dan putih itu ada wilayah abu-abu. Di situlah dilema etika berada. Korupsi, jelas tidak ada dilemanya, lha wong sudah jelas-jelas berstatus haram. Hukumnya jelas dan gampang dibedakan. Perbuatan itu dianggap tercela karena tidak sesuai dengan rasa keadilan atau norma-norma kehidupan sosial dalam masyarakat.

Contoh Kasus : Komisi Pemberantasan Korupsi mengatakan tengah menelusuri pihak pemberi suap kepada mantan Ketua Mahkamah Konstitusi Akil Mochtar di kasus sengketa pemilukada selain Gunung Mas dan Lebak. Pemberi lain diduga berasal dari kasus sengketa pemilukada Palembang dan Empat Lawang, Sumatera Selatan.

“Ini pengembangan, apakah ada penerima lain. Apakah ada pemberi lain. Bisa ke pemberi bisa ke penerima,” kata juru bicara KPK Johan Budi S.P., saat memberikan keterangan pers, Rabu, 30 Oktober 2013.

Menurut Johan, salah satu cara penelusuran dilakukan lewat pemeriksaan dan penggeledahan yang sudah berlangsung selama dua hari, sejak kemarin. KPK sudah melakukan penggeledahan terkait dengan penyidikan dugaan tindak pidana korupsi dalam pengurusan sengketa pilkada di Mahkamah Konstitusi dengan tersangka Akil di dua tempat, kantor Walikota Palembang serta kantor dan rumah Bupati Empat Lawang.

“Penyidik mengamankan sekardus dokumen dari kantor itu. Termasuk dokumen yang diduga berkaitan dengan pemilukada,” katanya.

Kemudian, hari ini penyidik melakukan pemeriksaan terkait kasus yang sama pada beberapa pejabat di Pemerintah Kota Palembang dengan bantuan Makosat Bripolda Sumatera Selatan. Yang diperiksa antara lain Sekretaris Daerah Ucok Hidayat, Kepala Dinas Prasarana Jalan dan Pengembangan Perairan Alex Verdinandus, Kepala Kantor Pelayanan Perijinan Terpadu Dian Kis Jualianto, dan Kepada Dinas Tata Kota Isnaini Madani.

Saat disinggung soal pemeriksaan Wali Kota Palembang, Johan belum bisa memastikan. “Kemungkinan diperiksa. Sepanjang diperlukan oleh penyidik, tentu akan diperiksa,” ujarnya.

Sementara itu, sumber Tempo di lingkungan KPK mengatakan bahwa KPK mengendus pemberi suap pada Akil terkait dengan pemilukada di Palembang dan Empat Lawang.

Saat ini, Akil sudah ditetapkan sebagai tersangka tindak pidana pencucian uang (TPPU) oleh Komisi Pemberantasan Korupsi.

Analisis : Jadi tindak korupsi sangat berkaitan dengan etika bisnis, karena tindakan korupsi bertujuan untuk memperkaya diri. Menurut saya tindakan korupsi harus menjadi tugas pemerintah untuk menghilangkannya, karena tindakan korupsi sangat merugikan negara dan juga rakyat. ada baiknya pemerintah berani memberi tindakan bagi pelaku korupsi dalam hal hukuman ataupun lainnya.

Pengertian Corporate social responsibillies (CSR), manfaat bagi masyarakat dan perusahaan serta perusahaan yang menerapkan CSR

CSR adalah sebuah konsep yang tidak hadir secara instan. CSR merupakan hasil dari proses panjang dimana konsep dan aplikasi dari konsep CSR pada saat sekarang ini telah mengalami banyak perkembangan dan perubahan dari konsep-konsep terdahulunya. di wilayah Asia, konsep CSR berkembang sejak tahu 1998, tetapi pada waktu tersebut belum terdapat suatu pengertian maupun pemahaman yang baik tentang konsep CSR. Sementara itu, di Indonesia konsep CSR mulai menjadi isu yang hangat sejak tahun 2001, dimana banyak perusahaan maupun instansi-instansi sudah mulai melirik CSR sebagai suatu konsep pemberdayaan masyarakat. Perkembangan tentang konsep CSR pun pada dasarnya semakin meningkat lebih baik, ditinjau dari segi kualitas maupun kuantitas. Menurut Kotler dan Nancy (2005) Corporate Social Responsibility (CSR) didefinisikan sebagai komitmen perusahaan untuk meningkatkan kesejahteraan komunitas melalui praktik bisnis yang baik dan mengkontribusikan sebagian sumber daya perusahaan Menurut CSR Forum (Wibisono, 2007) Corporate Social Responsibility (CSR) didefinisikan sebagai bisnis yang dilakukan secara transparan dan terbuka serta berdasarkan pada nilai-nilai moral dan menjunjung tinggi rasa hormat kepada karyawan, komunitas dan lingkungan. Corporate Social Responsibilit(CSR)adalah suatu tindakan atau konsep yang dilakukan oleh perusahaan (sesuai kemampuan perusahaan tersebut) sebagai bentuk tanggungjawab mereka terhadap sosial/lingkungan sekitar dimana perusahaan itu berada. COntoh bentuk tanggungjawab itu bermacam-macam, mulai dari melakukan kegiatan yang dapat meningkatkan kesejahteraan masyarakat dan perbaikan lingkungan, pemberian beasiswa untuk anak tidak mampu, pemberian dana untuk pemeliharaan fasilitas umum, sumbangan untuk desa/fasilitas masyarakat yang bersifat sosial dan berguna untuk masyarakat banyak, khususnya masyarakat yang berada di sekitar perusahaan tersebut berada. Corporate Social Responsibility (CSR) merupakan fenomena strategi perusahaan yang mengakomodasi kebutuhan dan kepentingan stakeholder-nya. CSR timbul sejak era dimana kesadaran akan sustainability perusahaan jangka panjang adalah lebih penting daripada sekedar profitability. Manfaat bagi masyarakat dan keuntungan bagi perusahaan Manfaat bagi masyarakat dan perusahaan itu sangat bagus menurut saya dengan adanya CSR ini. Karena di dalam CSR ini terdapat point-point seperti : • Pengembangan Ekonomi misalnya kegiatan di bidan pertanian, peternakan,koperasi dan Usaha Kecil Menengah (UKM). • Kesehatan dan Gizi Masyarakat misalnya penyuluhan, pengobatan, pemberian gizi bagi balita, program sanitasi masyarakat dan sebagainya. • Pengelolaan Lingkungan misalnya penanganan limbah, pengelolaan sampah rumah tangga, reklamasi dan penanganan dampak lingkungan lainnya. • Pendidikan, Ketrampilan dan Pelatihan misalnya pemberian beasiswa bagi siswa berprestasi dan siswa tidak mampu, magang atau job training, studi banding,peningkatan ketrampilan, pelatihan dan pemberian sarana pendidikan. • Sosial, Budaya, Agama dan Infrastruktur misalnya kegiatan bakti sosial, budayadan keagamaan serta perbaikan infrastruktur di wilayah masyarakat setempat. Dari point-point tersebut jadi bias diambil kesimpulannya bawa manfaat CSR bagi masyarakat itu ialah masyarakat jadi lebih mudah dalam mendapatkan hak nya sesuai dengan sila-4, dapat membantu masyarakat apabila ingin melakukan kegiataan perekonomian, meningkatkan tingkat kesehatan, mengurangi tingkat penggangguran dan putus sekolah masyarakat. Kemudian keuntungan bagi perusahan adalah perusahaan lebih mudah mengalokasikan dana yang mengendap melalui kegiatan pemberian kredit bagi masyarakat yang ingin melakukan kegiatan ekonomi seperti (KUR) , perusahaan akan lebih mudah apabila ingin mencari karyawan sesuai yang diinginkan, dan dapat meningkatkan penghasilan perusahaan juga sebab apabila taraf hidup masyarakat maju maka daya beli masyarakat juga akan bertambah hal ini yang akan menjadi bertambahnya penghasilan bagi perusahaan. Perusahaan yang telah menerapkan CSR Pelaksanaan CSR di Indonesia memiliki domain yang tidak terlalu jauh berbeda satu sama lainnya, meskipun korporasi-korporasi yang melaksanakan CSR tersebut melaksanakan kegiatan bisnis yang berbeda-beda misalnya di sektor perbankan kegiataan CSR banyak difokuskan pada bidang pendidikan seperti yang dilaksanakan oleh bank Mandiri dan bank BNI. Beberapa program sosial BNI dalam membantu bidang pendidikan di antaranya pemberian beasiswa setiap tahun, bantuan sarana dan prasarana fisik dan alat tulis bagi sekolah/kampus, renovasi sekolah , program kewirausahaan mahasiswa, sarana pendukung pendidikan nonformal dan program edukasi khusus bagi semua kalangan. Pada bidang pendidikan, bank Mandiri memiliki sejumlah sub kegiatan seperti beasiswa, pembelajaran mengenai perbankan kepada siswa di daerah terpencil, penyediaan sarana penunjang pendidikan, dan renovasi sekolah-sekolah yang rusak. Bank Mandiri juga menaruh perhatian besar pada masalah yang dihadapi oleh masyarakat karena bencana alam. Pada tiga bencana besar yang belum lama terjadi di Indonesia yakni tsunami di Aceh dan Nias, gempa bumi di Yogyakarta dan Jawa Tengah, dan tsunami di Pangandaran, bank Mandiri dengan sigap segera mengulurkan bantuannya. Perusahaan pertambangan batubara yakni Bumi Resources menitiberatkan kegiatan CSR- nya pada bidang pengembangan kegiatan ekonomi masyarakat dibidang perikanan, pertanian, dan perkebunan, serta pada bidang perbaikan infrasturktur dan pemeliharaan kesehatan Tidak sedikit pula korporasi di Indonesia yang sangat memperhatikan implementasi CSR yakni dengan membentuk yayasan khusus untuk melaksanakan program CSR secara fokus dan berkelanjutan. Seperti PT. Unilever Indonesia Tbk melalui yayasan Unilever Indonesia yang sangat fokus pada pengembangan ekonomi masyarakat dan PT. HMSampoerna Tbk melalui yayasan sampoerna foundation yang fokus pada bidang pendidikan

Analisis : Jadi perkembangan CSR di negara Asia sudah banyak mengalami perkembangan khususnya di negara Indonesia CSR banyak diterapkan di perusahaan-perusahaan guna memberdayakan UKM ataupun juga masalah pendidikan dan sosial. Dengan begitu CSR sangat berdampak positif didalam kehidupan suatu negara tersebut.

Kegiatan perdagangan adalah aktivitas wajib manusia yang terjadi di sekitar kita untuk memenuhi berbagai kebutuhan hidup sehari-hari. Tanpa adanya kegiatan jual beli antara pembeli dan penjual, maka manusia akan sulit mendapatkan apa-apa yang dibutuhkannya. Dalam keseharian kita terbiasa dan akrab dengan keberadaan penjual barang-barang kebutuhan hidup sehari-hari dalam bentuk toko kelontong/warung kelontong dan mini market.
Apa saja manfaat, kegunaan, fungsi dari mini market dan warung kelontong yang ada di sekitar kita? Mari kita lihat kebaikan-kebaikannya berikut di bawah ini :

Di mini market kita bisa bebas melihat-lihat produk yang dipajang rapi. Sebelum membeli produk yang kiranya masih asing bagi kita sebaiknya dipelajari terlebih dahulu dengan meraba dan membaca. Jika di televisi dan internet kita bisa lihat gambar beserta spesifikasinya, maka di toko/warung kelontong dan minimarket kita bisa melihat produknya secara langsung.
3. Tempat Rekreasi atau Cuci Mata
Cobalah main ke mini market untuk membeli makanan atau minuman ringan di saat kita sedang stress. Hal tersebut bisa membantu kita relaksasi sesaat dari berbagai masalah yang terus melanda dari waktu ke waktu. Udara dingin AC yang dipasang di mini market membantu menyegarkan kembali tubuh kita dari udara panas luar ruangan. Untuk sekedar melihat-lihat produk yang dijual di mini market tanpa membeli sesuatu pun boleh-boleh saja asalkan jangan terlalu sering. Mini market ataupun toko kelontong / warung klontong modern bisa menjadi pelipur lara, tempat rekreasi dan tempat cuci mata untuk diri kita sendiri beserta keluarga dan teman-teman kita.
4. Tempat Bersosialisasi dengan Warga Masyarakat
Saat sedang mengunjungi mini market maupun toko/warung kelontong mungkin saja kita bertemu dengan orang-orang yang kita kenal, seperti teman, tetangga, saudara, bos, anak buah, dan lain sebagainya. Dengan bertemu secara langsung dengan orang-orang yang kita kenal dapat melakukan komunikasi untuk memperkuat hubungan sosial diri kita dengan orang tersebut. Sangat mungkin sekali seseorang yang masih lajang mencari jodoh/pacar di dalam mini market atau warung/toko klontong, karena minimarket dan toko/warung adalah tempat belanja umum yang dikunjungi oleh banyak orang, baik yang tinggal di sekitarnya maupun yang tinggalnya jauh darinya.
5. Tempat Menukar Uang Receh atau Uang Besar
Jika kita butuh menukarkan uang receh atau uang besar, maka kita bisa mencoba menukarkannya ke warung, toko atau minimarket yang ada di dekat keberadaan kita. Namun jumlahnya jangan terlalu besar terutama untuk pertukaran uang besar menjadi uang kecil (recehan) karena mereka juga sangat membutuhkannya sebagai uang kembalian jika ada pembeli yang membeli barang dagangan mereka dengan uang besar.
Dan masih ada banyak lagi fungsi-fungsi lain yang bisa kita gali dari suatu mini market maupun toko/warung kelontong yang ada di sekitar tempat tinggal kita. Keberadaan mereka jelas sangat dibutuhkan selama memiliki izin yang lengkap serta tidak bertentangan dengan hukum agama dan hukum negara yang berlaku. Tanpa adanya mereka sudah pasti akan menyulitkan kita ketika butuh sesuatu yang biasa kita gunakan sehari-hari.

Analisi : Menurut saya dengan adanya minimarket sekitar komplek rumah saya sangat berdampak positif atau membantu karena banyak orang bekerja kantoran tidak memiliki waktu yang banyak untuk ke mall untuk membeli kebbutuhan sehari-hari bisa berpaling ke minimarket yang ada disekitaran rumah dan juga bagi warga komplek sangat terjangkau jaraknya.
